			<content:encoded><![CDATA[<p>There is a lot we can talk about Googasian P.C., but the recent post on <a href="http://www.deangoogasian.com/">http://www.deangoogasian.com</a> by Robert Green is worth mentioning here.  Googasian pretends to be a champion of class-action cases but according to Robert Green Googasian P.C., has nothing to do with such cases.  As we know Robert Green is one of the most prominent class-action practitioners and his email in response to the recent post on <a href="http://www.deangoogasian.com/">www.deangoogasian.com</a> with a title “<span style="text-decoration: underline;">Why Students have decided to stay away from the Belford lawsuit</span>” is an eye opener for Googasain P.C.</p>
<p>Basically Mr. Green says that class action lawsuits are seldom successful and professional class action lawyers never engage in the kind of activity that Googasian gets himself into. He’s been starting lawsuits like the ones against Belford and Computer Training Institute because class action is not his area of practice and he can afford to put that side of career at risk. Basically, it doesn’t matter to him whether he wins or loses, and he doesn’t care about the loses of his clientele either. Otherwise he wouldn’t embark on such pointless pursuits as the case against Belford</p>
<p>Robert Green highlights the Googasian malevolence with the following words:</p>
<p>“I wanted to write to you about this group of jokers the Googasian P.C. ever since you started this blog. I was approached by one of his former clients through an acquaintance of mine about three years ago. Googasian had filed a case against the Court Reporting School back then; this was his first foray into class action. Yup that’s true, contrary to what you’ve been specifying on this blog, Googasian isn’t really a class action veteran. His expertise is in other areas of law, class actions are uncharted territory for him, for the most part.”</p>
<p>So,  Googasian and his associates  don’t have any expertise in class action. Robert Green further says, “See, class action is dirty business. You get your hands in the muck and most times you come out with nothing but dry dirt. Most class action lawsuit never go to trial. If they even take off, the chances of success are minimal. Minimal. Juries can usually distinguish between respect for law, and greed for money and that’s where the cases usually fall apart. So, with the cards stacked against “the people” so monumentally, what is it that even makes the practice of class action lawsuit a viable career? I’ll give you three words. “Damage to reputation”.”</p>
<p>“I am writing this email, because having a reputation as one of the legal granddaddies in the area of class actions, I feel Googasian is a novice infringing on some sacred territory unwashed. Class action has got much bad reputation over the last few years because of opportunists like Googasian. I want to make sure that that has been registered and I want to warn people to stay away from charlatans like him. Thanks for your blog.”</p>
<p>Googasian is causing real humiliation for all legal firms. Robert Green, on the other hand, has the kind of status and reputation that cannot be doubted &#8211; particularly about class-actions. Therefore his views can’t be overlooked.</p>

			<content:encoded><![CDATA[<p>If you want to know why none of the people from the Belford student body have opted to join in the cause of Googasian and his fools, just do a quick search on class actions. Here’s what Wikipedia has to say for instance.</p>
<p>“The preamble to the Class Action Fairness Act stated that… class actions harmed class members with legitimate claims and… undermined public respect for the country&#8217;s judicial system.”</p>
<p>This is no coincidence. Imagine the stereotypical conception of the legal shark; the person who’d come to your mind would be an ambulance chaser; a class action specialist so to speak. Class actions have earned a tarnished reputation simply because of the way some in the legal profession have been able to manipulate the law to extort money out of unsuspecting defendants as well as naïve clients.</p>
<p>Don’t get me wrong. Class actions are a very significant tool and have been used extensively by well intentioned lawyers to curb in corporate malpractice, but it’s also a tool, that owing to its nature lends itself rather well to abuse.</p>
<p>Lawyers who don’t have the qualification to earn themselves respectable positions in avenues of traditional practice find it really easy to start a civil action practice of their own. All it takes is a cheap office in an urban neighborhood with lots of less educated, malleable individuals walking around and an eagerness to make money off of other people’s loss.</p>
<p>We’ve discussed cases of exemplary abuses of class action earlier on this blog as well. Simply put, class action lawyers, although in many cases do not charge their clients up front, expose their clients to significant risks of legal recourse, financial harm and potential imprisonment. If case a class action lawsuit is dismissed, the defendant has the right to countersue. This makes a class action a highly risky venture for the claimants.</p>
<p>No wonder no one from the generally smart Belford alumni community is willing to join Googasian’s fool’s mission.</p>

Unable to serve a written notice to Belford, Googasian finally got the permission from court to go ahead with an email, fax or even a chat conversation to serve the notice. The Michigan court must’ve recognized this as an isolated case and Googasian must’ve worked really hard to get to this point, because usually the courts are able to predict the likely outcome in such circumstances.<span id="more-58"></span></p>
<p>Belford has no reason to worry though. Their Terms of Service clearly state that they are a non-US entity, and that has been mentioned many times here already. This whole ‘case’ (there isn’t any!) is what they call ‘an exercise in futility’. Without a subpoena, the best Googasian would get is a disclosure of information, which would not help him make any case – he would know that if he is even half a lawyer.<!--more--></p>
<p>This is starting to look like an ego battle now. Like the little child whose candy has been snatched from him and now he runs after the other person greedily, sticky hands spread out.</p>
<p>(Googasian got $2.5 million in candy earlier and it is understandable that he just wants more – and he is not walking the most ethical path to achieve his goal.)</p>

<p>Googasian’s motion has been dismissed by the court. Yes, just as expected by anyone having even the farthest knowledge of the laws, right from the very beginning.<span id="more-50"></span></p>
<p>What really were the components of the motion, you ask? Now what I am going to tell you is going to either give you yet another generous laugh at Googasian or totally shock you out of your mind!! Well, Googasian has crossed the limits of ridiculousness lately, by pleading the court to allow him to serve the notice in the following three ways:<!--more--></p>
<p>Email the      authorities of Belford</p>
<ol>
<li>Put up a notice      on a self-fabricated website of the law firm, in order to prompt the      institution to come forth in the court</li>
<li>Put up a notice      within the premises of the court</li>
</ol>
<p>Outcome? None of the above was entertained by the court who stated that the law firm is yet to present something ‘reasonably calculated’ against Belford and are unable to prove anything, except their own unforgivable degree of incompetence.<!--more--></p>
<p>Next thing we know, the case itself, altogether would be outright dissolved by the court due to pretty much the apparent reason that to-date the plaintiff has not been able to convince the court on serving a legal notice to the defendant. End of story.<!--more--></p>
<p>Imagine, can you? Googasian still has the nerves to go about wishing upon stars despite being time and again met by failure, right from the beginning of having filed the Belford Lawsuit. Okay, we agree, winning is highly important to some people but losing your sanity in the process is simply not the way to go.<!--more--></p>
<p>By continuing to act unreasonably and unjustifiably, Googasian is only further cementing its newly (but rightfully so) earned disrespect in the legal fraternity, what with always coming up with painfully obvious baseless accusations that holds no ground, never did, never would.<!--more--></p>
<p>What’s interesting is that while Belford has come out scratch-less from this <em>uncalled-for</em> battle, on the contrary having won itself some major free publicity, Googasian on the other hand is the one left with practically nothing but shrunken pockets (just what it wanted to fill out at the expense of Belford and its alumni’s future), enormous negative publicity (thanks to Belford’s united alumni), distrust in its current clients and nil chance of earning any new ones for that matter.<!--more--></p>
<p>At the expense of sounding clichéd may I state here that if you dig a trench for others, chances are you would fall into it yourself! That’s just what’s been happening to Googasian. After all the baseless accusations it’s devised and the malice it’s plotted against Belford, has in the end merely caught up to itself.  All we can say now is that Googasian is steadfast in ensuring that his legal career is history, real soon.</p>

Googasian P.C has recently responded to the many discussions taking place on various websites and discussion boards online.<span id="more-47"></span></p>
<p>Googasian P.C now declares that Belford  High School is jeopardizing its reputation by means of such websites and is indirectly threatening the students who may intend to join the Belford Lawsuit class action. Googasian P.C proliferates that Belford High School has launched these websites for the purpose of defaming the firm without realizing even for a moment that the internet is after all a free medium accessible to everybody and most probably the websites in question are initiated by Belford’s alumni, other online educationists, individuals considering to pursue education and life experience based diplomas/degrees online or generally anyone interested in the education current trends.<!--more--></p>
<p>The people contributing to such websites and discussing as to how students associated with the Belford Lawsuit class action maybe counter-sued are only showing their own perspective in relevance to the case, based on facts easily available on the internet &#8211; be it about Belford, Googasian P.C, or other relevant cases where they may have clearly witnessed this trend of seeing how only the attorneys walk out with heavy amounts of profit (in case of winning the case) or being counter-sued along with the innocent participants of the class action.<!--more--></p>
<p>Googasian P.C sternly accusing its defendant in such a manner only further proves its incompetence in devising a case on such week grounds; just as earlier the firm blatantly ignored the high school’s Terms &amp; Conditions given on its official site which clearly protects the defendant.<!--more--></p>
<p>However it would amuse you to know that finally, Googasian P.C took notice of this loophole and now states that Belford  High School has only recently changed its Terms &amp; Conditions in order to defend itself from the class action filed. I assure you that it is simply not true as I have found their Terms &amp; Conditions to be the same as ever since the commencement of the institution. Googasian P.C should therefore prove this accusation straight out by presenting dated ‘before’ &amp; ‘after’ snapshots of the high school’s official website, precisely the Terms &amp; Conditions webpage.<!--more--></p>
<p>Googasian P.C has requested for subpoena to be issued to Belford by the court in order to disclose the identity of the authorities behind the high school. It is however clear that subpoena is only issued in case of copy infringement.  The law firm could also pursue the <em>Digital Millennium Copyright Act</em> in order to file a notice of infringement in this regard.<!--more--></p>

<p>The frustration in which Googasian P.C finds itself due to the Belford Lawsuit – getting to simply nowhere lucrative for the law firm, has reduced Googasian P.C to nothing but bare laughing stock for all.</p>

<p>Since November this year, we have been talking about the Belford Lawsuit across a wide range of forums and blogs online. It was heartening to see how the alumni got united to support Belford High School along with some notable educationists and professionals from the legal fraternity. <span id="more-36"></span></p>
<p>We have talked in great detail about the futility of the case. The consensus is that Googasian P.C, the law firm, is acting as the puppet of some organizations, which obviously have problems with the growing popularity of degrees based on life experience. I cannot write and say it better than Mr. Eric. <a href="http://educationfuturist.wordpress.com/2009/11/11/the-belford-lawsuit/" target="_blank"><strong>Read his blog post here.</strong></a><!--more--></p>
<p>To summarize his point of view, he states that this lawsuit is baseless on two grounds. Firstly, Belford High School is a non-U.S. entity and secondly the terms of service mentioned on the website clearly protect Belford against any lawsuit of this nature. <!--more--><br />
Googasian, however, seems little interested in the actual outcome of the case. As I just said, they are more interested in creating negative press against Belford. This move, however, will be defended with more vigor and strength than Googasian could have imagined. The alumni and other associated groups of Belford will continue to expose this law firm’s real and true face to the general public. For that we’re in talks with a number of victims of Googasian’s corrupt lawsuits and they are willing and desperate to help us n this regard.<!--more--></p>
<p>Where is this case leading to?<br />
The million-dollar question is, despite all this brouhaha, what is actually happening to the case? Well, the short answer is NOTHING. Longer is, there are 3 possible scenarios.</p>
<p><strong>Scenario A:</strong></p>
<p>The court will not accept the case, based on the fact that Belford does not come under the jurisdiction of the courts in the United States. Since they won’t be able to summon the defendant, the case will not proceed.</p>
<p>Outcome: Googasian gets nothing, loses money on the publicity stunts, and faces a tsunami of publicity against the firm from the alumni.</p>
<p><strong>Scenario B:</strong></p>
<p>The court accepts the case, but then it’s rejected based on the grounds that Belford does not come under the jurisdiction of the courts in the United States and that their terms of service protect them from the lawsuit.</p>
<p>Outcome: Googasian gets nothing, loses money on the publicity stunts, and faces even more negative press</p>
<p><strong>Scenario C:</strong></p>

The court rules in favor of the plaintiff, with the high school being ordered to pay thousands of dollars in damages.  Googasian is happy, the plaintiffs are happy! But wait, they don’t  get any money from the School. Did I mention Belford is not based in US?<!--more--></p>
<p>Outcome: Googasian wins the case yet gets nothing, loses money on the publicity stunts, and faces embarrassment and negative press.</p>
<p>Two options for Googasian P.C</p>
<p>1) Back off! Retreat the case, and I, being the representative of all the alumni blogs and forums will make sure all the negative publicity about the firm is immediately stopped. <!--more--></p>
<p>2) Do not retreat the case but stop and stop any negative press against the high school. This includes not sending out any press releases, taking down the website, belfordlawsuit.com and related websites. In return, I will make sure all websites targeting the case and the law firm stops all negative publicity. <!--more--></p>

			<content:encoded><![CDATA[<p>Alright folks, there finally is some reaction from the otherwise dumbfounded law firm, Googaisan P.C. to all the notes we have been making of how its class action against Belford High School is week to the knee. Yes, please come up with something as lame as you can since by now, I am sure, we all can pretty much gorge the low caliber of these attorneys. <span id="more-29"></span></p>
<p>By the way, the law firm is still in the loop of actually filing its class action – Belford Lawsuit with a court as obviously how can they, when Belford does not operate within the US jurisdiction? So they have recently appealed at the registrar office to issue a subpoena addressed to all the websites discussing Belford Lawsuit, in favor of the high school, in order to track as to who the central authority is behind it all.  So at least they know that much by now. <!--more--></p>
<p>Googasian P.C is absolutely irritated by all such websites where Belford’s alumni members like me have initiated discussions backing Belford – not because of any soft corner that we may harbor for the institute, but purely basing our arguments on plain facts. The law firm now accuses Belford High School of ‘threatening its prospective clients’, in other words putting plain sense into them if they intend to make some money if the firm manages to win the case. <!--more--></p>
<p>I would like to inform Googaisan P.C. that all such websites are very much the works of Belford’s alumni and this is only the first steps we’ve taken towards coming together as one united force and would only keep going further from here to protect the name of our high school. In no way would we let Googasian have it so easily – what with satisfying its never ending greed by filing a case as baseless as this. Haven’t you all time and again heard each time the law firm walk out with heavy amounts of profit (in case of winning the case) or being counter-sued along with the innocent participants of the class action? <!--more--></p>
<p>We the alumni believe that Googasian has filed this case either to earn some easy money, or it’s some funded campaign against Belford High School to tarnish its image And if that’s really the case, then we will not only protect our high school but will reply with the same if not more amount of negative publicity against the Googasian Guys. If they stop and retreat, we will let them stay in peace, or else, it’s the beginning of a long and rough ride for Googasian.</p>

Here goes; Googaisan P.C had no other option but to re-submit the case with some updated points as no students were willing to join the class action, without it will not be entitled to be called one to begin with.<span id="more-40"></span></p>
<p>For your information, not even a single student has joined the case, letting the thousands of dollars Googasian P.C invested in the promotion of the case, go down the drain. They have even advertised on search engines. Unfortunately, Googasian P.C still was not able to convince students.<!--more--></p>
<p>So clearly, for Belford Lawsuit to be filed as a class action in the first place there is an awful need of supporters the basis of legal documentation available online. As of now, Googasian P.C is behaving like a wailing child who receives no acknowledgment due to his past ill reputation and unreasonable demands.<!--more--></p>
<p>The fact that there are no supporters even after having re-submitted the case on the basis of “thousands of victims” only complicated the matter than helped it in any way for the law firm.<!--more--></p>
<p>The reason for Googasian P.C’s failure to find students is simply because the Belford Alumni knows what they have got. They were promised a globally accredited degree based on their life experience and that is just what they received. Googasian P.C must now realize that students are much more tech- savvy today and are pro at browsing and finding the exact information they require and thus make informed decisions. So claiming how students were ‘scammed’ by Belford was anyway a lame accusation.<!--more--></p>
<p>Furthermore, it is not only Googasian P.C that is at risk of counter attack but the class, however insignificant in number, might also face the consequences that would negatively affect their personal and professional lives. Thus, one should think before they leap and that is exactly what Belford Alumni is doing in this case, keeping themselves away from the uncalled for drama.</p>

			<content:encoded><![CDATA[<p>Life Experience Degrees have gained a lot of attention lately among people from varied age groups and fields of profession, being awarded to those who have managed to master in central competencies of knowledge, skills and experience in a certain profession. Currently, a number of online institutions are granting life experience degrees by assessing the prior experience of individuals through different techniques. Life experience degree holders surely get similar opportunities from employers and educational institutions as their counterparts. A recent study showed that between 90-95 percent employers keenly hire people who have been honored with life experience degrees.<span id="more-27"></span></p>
<p>Amusingly the rivals of Life Experience degrees just cannot classify any such degree as ‘fake’ except in cases where they sport a similar name or resemble the ones issued by any other institutions. Recently, a law firm called Googasian P.C. has misleadingly filed a class action against Belford High School – a life experience based online institution.<!--more--></p>
<p>Supporters of life experience degrees on the other hand, see it as an absolutely legal medium as hundreds of life experience degrees awarding institutes today productively function in US and on globally, honoring deserving individuals for their prior life experiences without claiming to be ‘educating’ them for the degree awarded. Calling these degrees ‘bogus’ would be plain unlawful as unmistakably the degrees awarded are based on genuine work experiences of the holders in the truest sense.<!--more--></p>
<p>Googasian P.C. has won settlement money against a local high school recently and must have filed the class action against Belford with either the parallel intentions of making more money or other malicious intentions. By even opening up websites reserved wholly solely for the purpose of apparently ‘coming to the rescue’ of such distressed students who may have received fake degrees from other online life experience based institutions shows that Belford has only been targeted who Googasian was aware of, (that has been around successfully since years in the industry, enjoying goodwill and respect) and through its aforesaid websites it is in fact obtaining a list of other such life experience based institutions which can be the next targets of its malicious plans.<!--more--></p>
<p>Chances are high that Googasian is a front-end player of a certain lobby possibly comprising of traditional educationists and institutions, looking to jeopardize the reputation of the life experience industry. In case you may have heard stories like a cat or dog being awarded a life experience degree, rest assured that such accusations are baseless as how can one blame the institute for awarding a degree on the basis of the credentials they have received while their terms &amp; conditions clearly state that incase of any misrepresentation, the degree will be ‘cancelled’. All information is submitted on oath and ‘pain of perjury’ as the degree then stands ‘null and void’ if one has misrepresented their credentials’ information.<!--more--></p>
<p>A famous case should thus aptly be quoted here having taken place in 2006 filed by Mr. Paul McKenna against Daily mirror newspaper who called his degree ‘bogus’. In the year 1996, McKenna was awarded the doctoral degree PhD degree from LaSalle University (Louisiana) on completing a 70,000-word thesis on a study. In 2006 McKenna successfully sued the Daily Mirror for libel; over claims made by journalist Victor Lewis-Smith that McKenna obtained a &#8220;bogus degree&#8221; simply for money to intentionally deceive the public. McKenna won the case and significant damages. The court declared that Mr. McKenna was not dishonest and regardless of the quality of his earned degree, it would be unfair to write it off as &#8216;bogus&#8217; and that any presumable lack of academic expertise of La Salle&#8217; University does not suggest that its client has been dishonest about his rightfully earned credits based on his life experiences.<!--more--></p>
<p>So does the law firm Googasain P.C. look forward to an upshot like Daily Mirror Newspaper? We can clearly see how Belford  High School’s terms &amp; conditions given its their official website alone unmistakably guard their case.</p>
